Privacy Policy
This Privacy Policy applies to Company Radar, a service of Smoko Labs Pty Ltd (ABN to be confirmed), and related products including Gone Quiet, Gone Quiet Intelligence, and the Accountant Dashboard.

Summary
Company Radar primarily displays publicly available information sourced from Australian government registers (ASIC, the Australian Business Register, and state building licensing authorities). Almost none of the data we publish constitutes personal information — it relates to companies, not individuals. For users who create accounts or subscribe to monitoring services, we collect only what is necessary: an email address and standard usage analytics. We do not sell your data. We do not use it for advertising. This policy explains what we collect, why, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

What Data We Hold
2.1 Company register data (not personal information)
The vast majority of data displayed on Company Radar relates to companies, not individuals. This includes company names, Australian Company Numbers (ACNs), Australian Business Numbers (ABNs), company status, registration dates, registered addresses, insolvency notices published by ASIC, administrator and liquidator appointment notices (which are public ASIC publications), and state building licence register data. This information is sourced from public government registers and is not considered personal information under the Privacy Act 1988 (Cth).
2.2 Personal information we collect from users
For users who register for Company Radar's monitoring services, we collect:
- Email address — required to create an account and deliver monitoring alerts
- Name — optional, used to personalise communications
- Payment information — billing is handled by Stripe. We do not store or process card numbers directly; all payment data is held by Stripe under their own privacy and security obligations
- Usage analytics — page views, search queries, feature interactions. This data is aggregated and used to improve the service
- IP addresses and server logs — retained in standard web server logs for security and operational purposes
Company Radar's free search function does not require registration or identification.
How We Use Your Information
We use personal information only for the purposes for which it was collected:
- Delivering the monitoring and alert services you have subscribed to
- Processing payments and issuing receipts
- Sending transactional emails (account setup, alert digests, billing notifications)
- Responding to your enquiries and support requests
- Improving the product through aggregated usage analysis
- Complying with legal obligations
We do not sell, rent, or trade your personal information to third parties. We do not use your data for targeted advertising or profiling.
Australian Privacy Principles
The Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs) govern how we handle personal information. We note that the small business exemption (annual turnover under $3 million) may apply to Smoko Labs Pty Ltd; however, we choose to comply with the APPs as a matter of best practice and to maintain user trust. Here is how each APP applies to our services:
APP 1 — Open and transparent management of personal information
This Privacy Policy is the primary means by which we meet our APP 1 obligations. It is publicly available at companyradar.com.au/privacy and linked from the footer of all our products. We will update it when our practices change and notify users of material changes by email where we hold an address.
APP 2 — Anonymity and pseudonymity
Company Radar's free search requires no account and no identification. Anyone may search our public company data anonymously. Users who choose to create a monitoring account must provide an email address, which is necessary for delivering alerts — anonymous use of the monitoring service is not practical. We do not require users to provide their real name.
APP 3 — Collection of solicited personal information
We collect only the minimum personal information necessary for the service: an email address for account holders, payment data via Stripe, and standard web analytics. We do not collect sensitive information (health, financial, biometric, etc.) and we do not seek to profile individuals. We collect information directly from users when they register or subscribe.
APP 4 — Dealing with unsolicited personal information
If we receive personal information we did not solicit and could not have collected under APP 3 (for example, someone emailing us personal details about a third party), we will either return or destroy that information as soon as practicable, provided it is lawful and reasonable to do so. We do not retain unsolicited personal information beyond what is necessary to assess whether we are required to hold it.
APP 5 — Notification of the collection of personal information
This policy serves as our collection notice. At registration or subscription, users are directed to this policy and our Terms of Service. We collect personal information to provide the monitoring service, for billing and administration, and for product improvement. The policy is accessible at all times via companyradar.com.au/privacy.
APP 6 — Use or disclosure of personal information
We use personal information only for the primary purpose for which it was collected — delivering the service you signed up for. We disclose personal information to third-party service providers only where necessary to operate our services (e.g., Stripe for payment processing, analytics providers). We do not sell personal information. We may disclose information if required by law or to enforce our Terms of Service.
APP 7 — Direct marketing
We may send product updates and feature announcements to users who have consented to marketing communications. Every marketing email includes an unsubscribe link that takes effect immediately. We do not send marketing communications to users who have not opted in, and we never use your information for third-party marketing.
APP 8 — Cross-border disclosure of personal information
Some of our service providers process data outside Australia. This includes analytics platforms (which may process data in the United States or European Union) and our payment processor, Stripe (US-based, operating under applicable data transfer frameworks). We take reasonable steps to ensure overseas recipients are subject to privacy obligations substantially similar to the APPs, or we rely on your consent. By using our services, you acknowledge that your information may be transferred to and processed in countries outside Australia.
APP 9 — Adoption, use or disclosure of government-related identifiers
Company Radar displays ACNs and ABNs as identifiers of companies and business entities, not individuals. ACNs and ABNs are public-register identifiers for corporate entities. We do not adopt government-issued identifiers as our own identifiers for natural persons, nor do we use them in a way that would identify an individual beyond their role as a company officer (where that information is already publicly published by ASIC).
APP 10 — Quality of personal information
We take reasonable steps to ensure that personal information we hold is accurate, up-to-date, and complete. Register data displayed on Company Radar is sourced directly from government registers; its accuracy is the responsibility of those registers and the entities that file with them. For user account information, you may update your details at any time via your account settings. See also APP 13 (correction) below.
APP 11 — Security of personal information
We implement industry-standard technical and organisational security measures to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. Measures include encrypted data transmission (TLS), access controls, and regular security reviews. When personal information is no longer needed for any purpose, we take reasonable steps to destroy or de-identify it. If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.
APP 12 — Access to personal information
You have the right to request access to the personal information we hold about you. To make a request, contact us at support@companyradar.com.au. We will respond within 30 days. We may need to verify your identity before releasing information. In most cases, access will be provided free of charge; however, if a request is complex or voluminous, we may charge a reasonable fee and will advise you in advance.
APP 13 — Correction of personal information
If you believe personal information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, you may request a correction by contacting support@companyradar.com.au. We will take reasonable steps to correct the information within 30 days. If we disagree that a correction is warranted, we will explain our reasons and advise you of your right to complain to the OAIC.
Cookies and Tracking
We use cookies and similar technologies to operate our services and understand how they are used. The types of cookies we use:

Always active
Session management, authentication tokens, and security cookies required for the service to function correctly. Cannot be disabled.
Analytics
Opt-out available
Page view counts, search query volumes (not the queries themselves), and feature usage statistics. Used in aggregate to improve the product. We use privacy-respecting analytics tools configured to anonymise IP addresses.
Preference
Functional
Theme preference (light/dark mode) and display settings stored locally. These contain no personal information.
We do not use advertising cookies, tracking pixels for ad networks, or cross-site tracking technologies. You may disable non-essential cookies via your browser settings; note that this may affect the functionality of some features.
Third-Party Services
We use the following third-party services to operate our products. Each provider has their own privacy policy and data processing terms.
Stripe
Payment processing. Stripe collects and processes payment card data on our behalf under their own PCI-DSS compliance framework. We do not receive or store card numbers. See stripe.com/privacy.
Analytics provider
We use web analytics software to measure usage patterns. Analytics data is aggregated and anonymised. IP addresses are truncated before processing. We do not share individual-level analytics data with any third party.
Email delivery
Transactional and monitoring alert emails are delivered via a third-party email service provider. Email addresses are shared with this provider solely for the purpose of delivering emails on our behalf. The provider is contractually prohibited from using your email address for any other purpose.
Government data sources
Company and register data is sourced from ASIC (Australian Securities and Investments Commission), the Australian Business Register (ABR), and state building licensing authorities (QBCC, NSW Fair Trading, Building Commission Victoria, and equivalent bodies). These are public-sector entities governed by their own legislation and privacy frameworks.
Data Retention
We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law:
- Account and contact information — retained for the life of the account plus 7 years after closure (to meet Australian tax and records obligations)
- Payment records — retained for 7 years as required by the Corporations Act 2001 and tax law
- Usage analytics — aggregated data retained indefinitely; individual session data deleted after 26 months
- Server logs — retained for 90 days for security monitoring, then deleted
- Support correspondence — retained for 3 years after resolution of the enquiry
When you close your account, we will delete or de-identify your personal information within 30 days, except where retention is required by law or necessary to resolve outstanding disputes or enforce our agreements.
Children's Privacy
Our services are not directed at, and are not intended for use by, persons under 18 years of age. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a person under 18, we will take steps to delete that information promptly. If you believe we have inadvertently collected information from a minor, please contact us at support@companyradar.com.au.
Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our services, legal obligations, or best practices. The current version will always be available at companyradar.com.au/privacy. We will note the effective date at the top of the policy. Where changes are material — for example, a new use of personal information — we will notify registered users by email at least 14 days before the change takes effect. Continued use of our services after changes take effect constitutes acceptance of the revised policy.
Complaints and Enquiries
If you have a concern about how we have handled your personal information, please contact us first. We will investigate and respond within 30 days.
